Dan Markel Case: Murder, Adelson Family and Verdicts

Dan Markel was a tenured Florida State University law professor who wrote about punishment and the justice system. On July 18, 2014, a stranger shot him twice in the head while he sat in his car in the garage of his Tallahassee home. He died the next day, aged 41. What looked at first like a random crime turned into a murder-for-hire case, and investigators traced it back to his ex-wife’s family, the Adelsons. It took more than eleven years, five people charged, and several trials before Donna Adelson, his former mother-in-law, was convicted. I have followed this case since the first arrests in 2016, and few true-crime stories show so clearly how a custody fight can turn deadly.

Who Was Dan Markel?

Dan Markel was a Canadian-born legal scholar who became one of the best-known young voices on punishment in American law schools. He joined the FSU College of Law in 2005, earned tenure in 2010, and focused his research on retributive justice and the morality of punishment.

Early Life in Toronto

Dan grew up in North York, Toronto, in a Conservative Jewish household with his parents, Phil and Ruth, and his younger sister, Shelly. He attended Forest Hill Collegiate, where he wrote for the school newspaper and competed on the debate team. Friends later described him as energetic and outgoing even as a teenager.

Faith mattered to him all his life. He kept kosher, attended Orthodox services as an adult, and studied for a period at the Hebrew University of Jerusalem. That commitment later played a surprising part in his marriage.

Education and Early Legal Career

Dan applied to Ivy League schools and went to Harvard, graduating magna cum laude in the mid-1990s. He then earned a master’s in political theory at Cambridge and returned to Harvard for law school. Philosophy and politics shaped the way he later wrote about the justice system.

After law school, he completed a federal appellate clerkship and worked as an associate at a Washington, D.C. litigation firm. In May 2005, he left practice for teaching and moved to Tallahassee to join FSU.

Scholar, Blogger and Networker

Among law professors, Dan was best known as the founder of PrawfsBlawg, a popular legal blog about academia and legal scholarship. He also hosted “MarkelFests,” informal gatherings at conferences where young law professors could meet and network.

His scholarship argued that punishment should be principled and limited, not driven by revenge. Colleagues often point out the grim irony that a man who wrote about fair punishment died in a crime rooted in personal vengeance.

Dan Markel’s Wife: How He Met Wendi Adelson

Dan Markel’s wife was Wendi Adelson, a lawyer from South Florida who specialized in immigration and human rights law. The two met in 2003 through JDate, a Jewish dating site, while Dan was in Washington, D.C. and Wendi was finishing law school at the University of Miami.

Dan Markel's Wife: How He Met Wendi Adelson

A Fast Romance

Wendi had graduated from Brandeis and later earned a master’s in international relations. The couple corresponded online, then spent weekends together in Cambridge and D.C. In 2004, Dan proposed with a diamond ring near the Sea of Galilee during a trip to Israel.

They married in 2006. Wendi followed Dan to Tallahassee, where she took a contract clinical law professor role at FSU. Friends noted that this was a lesser position than Dan’s tenure-track job, and the gap later became a point of tension.

The Kosher Wedding Incident

The first public sign of trouble came at the wedding in Boca Raton. The Adelsons hosted a lavish event, and the two families split the costs. Dan had asked for a fully kosher menu so his observant friends and rabbi could eat.

According to accounts later given to the New York Times and ABC’s 20/20, the food was not kosher. Meat and dairy were served together, and some guests walked out. Dan’s side felt blindsided. Looking back, many people who knew the couple saw the incident as an omen of how Donna Adelson would treat Dan.

Donna Adelson and the Adelson Family Dynamics

To understand the Dan Markel case, you have to understand the family he married into. Donna Adelson, a Coral Springs matriarch, was described in court as extremely controlling. She was involved in her children’s careers, love lives, home purchases, and even their religion.

Donna Adelson and the Adelson Family Dynamics

A Family of High Achievers

Donna’s husband, Harvey Adelson, was a periodontist who ran a successful South Florida dental practice. Donna managed the business side. Their son Charlie Adelson became a periodontist and joined his father’s practice. Their other son, Rob, became a dentist. Wendi went into law and academia.

The family’s Adelson Institute earned millions over the years. That money later became central to the murder case, because investigators found payroll entries that tied the family business to one of the conspirators.

Different Views on Religion and Control

The Adelsons practiced Reform Judaism and were relaxed about dietary laws. Wendi later testified that Donna was disappointed Wendi had married a strictly observant man. In the docuseries interviews, family acquaintances described Donna taking the boys to eat cheeseburgers and shrimp, foods Dan did not want his sons eating.

Prosecutors portrayed Donna as a woman who wanted round-the-clock access to her grandkids. When Dan stood in the way, prosecutors said, she saw him as an obstacle rather than a son-in-law.

Divorce and Custody Battle

The marriage collapsed in early 2012. Wendi filed for divorce in September 2012, and the divorce was finalized in 2013. The two sons, Benjamin and Lincoln, were very young at the time.

The Relocation Fight

Wendi wanted to move the boys roughly 500 miles to South Florida to be near her family. Dan refused. In 2013, a judge denied the relocation request, which meant the boys had to stay in Tallahassee. Friends say this ruling enraged Donna.

The financial side was bitter too. Settlement talks involved hundreds of thousands of dollars in cash and assets. Wendi also returned the engagement ring and fought over furniture and property.

Growing Hostility

After the divorce, Dan said the Adelsons badmouthed him to the children. In 2014, he filed a motion asking the court to stop Wendi’s family from disparaging him. A hearing was pending when he was killed.

Around the same time, Wendi was also considering school options and a charter school application that would have needed Dan’s cooperation. From Dan’s side, the conflict was a legal matter to be settled in court. Prosecutors argued the Adelsons saw it very differently.

The Dan Markel Murder: What Happened on July 18, 2014

On the morning of July 18, 2014, Dan dropped the boys at preschool and went to the gym. Around 11 a.m., he pulled into the garage of his home on Trescott Drive in Tallahassee. A gunman walked up to the driver’s side window and fired a .38-calibre revolver.

The Scene

A neighbour heard a loud boom and called 911. Dan was found in his car with gunshot wounds to the head. He was rushed to hospital, where he survived for about 14 hours before he was declared dead the next day.

Nothing was stolen. There were no signs of a robbery. For investigators, that detail pointed away from a random crime and toward a targeted killing.

The Prius Clue

Neighbourhood CCTV and surveillance video showed a light-coloured Toyota Prius, later identified as green, circling the area before the attack. One witness described the car like a shark circling. The Prius was the first real thread investigators could pull.

Investigators also found that Dan had been followed from the gym parking lot. That told them the killers had studied his daily schedule, including when he dropped off his children.

Dan Markel’s Death and the First Days of the Investigation

Dan Markel’s death stunned the Tallahassee legal community. He was a divorced father of two young sons, a respected scholar, and a familiar face at FSU. His family flew in from Toronto, and he was buried in the Toronto area following a Jewish funeral.

Early Theories

In the early weeks, the Tallahassee Police Department considered many theories, including a link to his work or a random stranger. Lead investigator Craig Isom and his team quickly turned their attention to the custody fight and the ex-in-laws.

Police interviewed Wendi soon after the killing. She told them she had driven past Dan’s street around the time of the shooting and saw the crime scene tape. That drive-by later became one of the most debated facts in the case.

Why the Case Stalled

For nearly two years, no one was arrested. Investigators had a car, a theory, and a motive, but no direct link. Friends of Dan grew frustrated. Some of his fellow legal bloggers and law professors began pushing publicly for justice.

Who Killed Dan Markel?

The Dan Markel case involved five people. Two hitmen carried out the killing, a middlewoman passed the money, and two members of the Adelson family were convicted of ordering it.

The Five Key Figures

Sigfredo GarciaGunmanConvicted of first-degree murder in 2019; life without parole
Luis RiveraGetaway driverPleaded to second-degree murder; 19-year plea deal; testified
Katherine MagbanuaMiddlewomanHung jury in 2019; retried and convicted of first-degree murder; life without parole
Charlie AdelsonPaid for the hitConvicted November 2023; life plus 60 years
Donna AdelsonHelped plan and fund the plotConvicted September 4, 2025; life without parole plus 30 years

The Hitmen

Sigfredo Garcia and Luis Rivera were childhood friends from Miami with ties to the Latin Kings gang. Garcia had a record including strong-arm robbery and aggravated assault. Rivera was already in prison on federal drug trafficking charges when he agreed to cooperate.

Rivera testified that Garcia fired the shots while he drove the rented Prius. He said they were promised $100,000 in cash. His testimony gave prosecutors an inside account of the plot, from scouting Dan’s gym to fleeing back to Miami.

The Middlewoman

Katherine Magbanua was Charlie Adelson’s girlfriend and the mother of Garcia’s children. Prosecutors said she connected Charlie with Garcia. After the murder, she appeared on the Adelson Institute payroll, receiving paychecks even though she did no real work there.

The Investigation That Cracked the Case

The breakthrough came through phone data and money trails. Investigators combed through thousands of phone records and linked Garcia and Rivera to the Prius rental. Toll transponder data and cellphone records placed them on the road between Miami and Tallahassee.

Following the Money

Financial records showed Magbanua receiving regular $465.50 paychecks from the Adelson Institute. For investigators, this looked like hidden payments for the murder. Magbanua had no clear job there, and the payments continued for years.

The FBI “Bump”

In April 2016, the FBI ran an undercover operation. An undercover officer posing as Rivera’s brother approached Charlie at a Miami Beach pizzeria. He told Charlie he knew about the killing and demanded money.

Charlie paid. Wiretaps then captured a flurry of calls between Charlie, Donna, and others. In a recorded call, Donna appeared to discuss moving abroad. For prosecutors, these secret recordings were some of the strongest evidence in the case.

Charlie Adelson’s Role, Arrest and Conviction

Charlie Adelson was named an unindicted co-conspirator long before charges came. Investigators knew his links to Magbanua and the payroll entries, but the FBI delayed the arrest while building evidence. He was finally arrested in April 2022.

The Trial

Charlie’s trial in Tallahassee was presided over by Judge Stephen Everett. Prosecutors Georgia Cappleman and Sarah Kathryn Dugan argued that he paid for the hit. His defense lawyer, Daniel Rashbaum, claimed Charlie was the victim of extortion by Magbanua and Garcia and only paid them out of fear.

Charlie took the stand himself. His explanation that he was being extorted did not persuade the jury. After about eight days of testimony, the jury deliberated for only a few hours.

The Verdict and Sentence

On November 6, 2023, Charlie was found guilty of first-degree murder, conspiracy, and solicitation. On December 12, 2023, he was sentenced to life in prison plus 60 years. Dan’s parents and his sons’ future were central to the victim statements at sentencing.

Prospects on Appeal

Florida law gives no gaintime or early release for a life sentence in a capital case. Charlie’s appeal rested largely on Rashbaum’s objections over excluded emails and texts. Under Florida’s abuse-of-discretion and harmless-error standards, legal observers have long seen his chances as dim, since juries decide credibility, not appeals courts.

Donna Adelson’s Arrest, Trial and Conviction

Donna Adelson dan markel coverage exploded on November 13, 2023. One week after Charlie’s conviction, Donna was arrested on the jetway at Miami International Airport as she prepared to board a one-way flight to Vietnam, which has no extradition treaty with the United States.

Trying to Flee

Donna and Harvey claimed it was a vacation. Prosecutors argued she had put her affairs in order and was fleeing. Wiretapped calls showed her discussing relocation and what might happen if she were implicated.

She pleaded not guilty to first-degree murder, conspiracy, and solicitation. Her lawyers described her as a meddler, not a mastermind, and argued she was a mother protecting her son rather than the plot’s leader.

The Verdict

The trial ran in 2025 with Georgia Cappleman again leading the prosecution. Magbanua, now serving a life sentence, testified and implicated Donna. On September 4, 2025, after about three hours of deliberation, the jury found Donna guilty on all charges.

She was sentenced to life without parole plus 30 consecutive years, the maximum sentence available. Ruth and Phil Markel gave victim statements describing a decade of grief. At 75, Donna became the fifth person convicted in the case.

Where Are Charlie and Donna Adelson Now?

Both Adelsons are serving life sentences, and both continue to fight their convictions.

Charlie was moved to a South Dakota prison after his conviction. A Florida appeals court upheld his conviction, and his appeals were denied in 2025. He continues to deny involvement in the murder.

Donna is being held at Homestead Correctional Institution in Florida. Her appeal argues the evidence was legally insufficient to prove she was a mastermind, and a brief was filed in August 2026. As of now, her appeal is pending, and legal watchers expect a long process before any ruling.

Where Is Wendi Adelson Today?

Wendi Adelson has never been charged. She testified at Garcia’s, Magbanua’s, and Charlie’s trials under immunity and has always denied any involvement in Dan’s death.

The Immunity Question

Wendi received use immunity, which bars prosecutors from using her own testimony against her. It does not give full protection like transactional immunity would. That means she could still be charged if prosecutors found independent evidence, but they have never announced charges.

Prosecutors once listed her as an unindicted co-conspirator. Still, the burden of proving guilt beyond reasonable doubt has kept the question unresolved in court.

Her Life Now

Wendi remarried attorney Jeffrey LaCasse and lives in South Florida with her sons. She has faced online hostility and harassment for years, and she testified that she was estranged from her mother by the time of Donna’s trial. She has said she believes her family may have tried to frame her.

Dan Markel’s Children and Dan’s Family After the Murder

Dan Markel’s children, Benjamin and Lincoln, were very young when their father was killed. Soon after, Wendi moved them to South Florida and changed their last name to Adelson. They are now in their mid-teens.

Cut Off From Dan’s Parents

Phil and Ruth Markel lost more than their son. For years, they had very limited contact with their grandchildren, mostly supervised Zoom calls. They said they were cut off after they spoke to the media. Ruth has said the loss of contact felt like a second death.

The Markel Act

The Markels pushed for a change in Florida law. The Markel Act lets grandparents petition for visitation when one parent was killed and the other parent is held criminally responsible or linked to the death. Lawmakers passed it in 2022 after strong support from the Markels and their allies, including lobbyist Karen Halperin Cyphers.

In my view, this is one of the most practical legacies of the case. It filled a real gap in Florida’s grandparent-rights law, one that many families never think about until tragic circumstances strike.

Ruth Markel’s Book

Ruth wrote The Unveiling, a mother’s reflection on grief, the trials, and life after her son’s murder. The title refers to the Jewish tradition of unveiling a headstone, an act that marks the passage of mourning.

Dan Markel Documentary: Netflix, Hulu and Dateline Coverage

Many readers search for a Dan Markel documentary on Netflix. There isn’t one. The main documentary is on Hulu, and network news magazines covered the case extensively.

Hulu’s “Welcome to the Family”

Welcome to the Family: The Murder of Dan Markel is a four-part Hulu docuseries released on January 2, 2026, and also available on Disney+ in some regions. It uses hundreds of family wiretaps and exclusive interviews, including with investigators and people close to the Markels. It renewed interest in the case more than 11 years after the killing.

The Dan Markel Dateline episodes are especially useful for viewers who want a clear timeline, since they cover the case trial by trial. 20/20 added interviews with juror Evan Higginbotham, who explained how the list of evidence convinced the jury.

Wendi’s Novel “This Is Our Story”

Before the divorce, Wendi published a 2011 novel, This Is Our Story. Its protagonist is a lawyer in an unhappy marriage who feels she married too quickly and lives in a city she dislikes. After the murder, readers pointed out the parallels to Wendi’s life with Dan in Tallahassee.

Dan Markel’s Legacy in Law

Beyond the courtroom, Dan’s colleagues made sure his work was not forgotten. The Dan Markel Award for Criminal Law Theory honors strong scholarship in the field he helped shape. On the 10th anniversary of his death in 2024, supporters marked the date under the banner “Justice for Dan.”

PrawfsBlawg continued after his death and remains a platform for law professors. For anyone studying criminal justice theory, his papers on retributive justice are still cited, which is perhaps the most fitting memorial for a scholar.
